Livwell Privacy Policy

Livwell Inc. (“Livwell,” “we,” “our,” or “us”) is committed to safeguarding your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use our website, mobile application, and related services (collectively, the “Services”). This Policy also serves as our notice at or before the point of collection.
1) Roles and How This Policy Applies
Livwell operates in two ways:
- Controller – for personal data we collect directly from consumers using the Livwell app or website.
- Processor / Service Provider – when we process data on behalf of our business customers (we call them “Subscribers”), such as gyms, studios, clinics, or wellness centres that use Livwell to manage their clients.
If you are an End User interacting with a Subscriber (e.g., you book a class with a studio that uses Livwell), some privacy requests (like deleting data the Subscriber controls) may need to be directed to that Subscriber.
2) Information We Collect
A. Non-Personal Information
We collect non-personal information that cannot reasonably be used to identify you, such as anonymised usage data, general demographic data, referring/exit pages, platform types, and preferences generated from your use of the Services.
B. Health Data Collection
To enhance your experience and provide personalised wellness recommendations, Livwell may collect or receive the following health-related data:
By accessing and using the Livwell platform, users consent to the collection, use, and processing of the following health-related data:
Active Calories Burned – Tracks calories expended during physical activities.
Distance – Measures walking, running, and overall movement distances.
Elevation Gained – Tracks climbing activities to provide insights into physical activity.
Cycling Pedaling Cadence/Exercise Sessions – Records cycling performance and activity sessions.
Floors Climbed – Monitors stair-climbing for improved activity metrics.
Steps Cadence/Steps – Tracks daily step counts and cadence for physical activity tracking.
Power – Captures exertion levels during physical activities.
Speed – Measures the speed of movement in real-time.
Respiratory Rate – Tracks breathing patterns to monitor physical health.
Basal Metabolic Rate (BMR) – Estimates calories burned at rest based on individual metabolic rates.
Body Fat Percentage – Provides insights into body composition and fitness.
Body Water Mass – Tracks hydration levels to maintain wellness.
Bone Mass – Monitors skeletal health and bone density metrics.
Height – Captures user height for calculating personalized health metrics.
Lean Body Mass – Tracks changes in muscle versus fat composition.
Weight – Monitors weight trends over time to provide actionable insights.
Menstruation Flow/Menstruation Period – Tracks menstrual health and cycles for personalized health management.
Total Calories Burned – Combines active and resting calorie expenditures for a full picture of energy use.
Hydration – Tracks water intake to ensure proper hydration levels.
Nutrition – Monitors dietary intake, including nutrients, for a comprehensive overview of health.
Sleep Session – Tracks sleep quality, duration, and patterns to improve rest and recovery.
VO₂ Max – Measures the maximum oxygen consumption during physical exertion.
Blood Glucose – Monitors blood sugar levels to support metabolic health management.
Blood Pressure – Tracks cardiovascular health for early warning signs.
Body Temperature – Monitors temperature changes to detect potential health concerns.
Heart Rate – Captures real-time heart rate data during activities.
Heart Rate Variability (HRV) – Tracks stress levels and recovery status.
Oxygen Saturation (SpO₂) – Measures blood oxygen levels to assess overall health.
Resting Heart Rate – Provides insights into baseline cardiovascular health and fitness levels.
Purpose of health data collection
– Personalise recommendations for physical activity, recovery, nutrition, and wellness.
– Track progress toward health and fitness goals.
– Offer engagement features (e.g., leaderboards and challenges).
– Generate actionable insights that support better wellness outcomes.
No advertising use of health data
We do not use health data, including Health Connect data, for advertising or advertising measurement purposes.
Security
Health data is encrypted in transit and at rest. We implement technical and organisational safeguards aligned with GDPR and, where applicable, HIPAA requirements.
Sources: Health data may come from wearables, manual input, or platform services (e.g., Health Connect on Android). The specific data types we read via Health Connect are listed in Section 2C and may be a narrower set than the overall list in this section.
C. Health Connect by Android (Optional Integration)
If you choose to connect Health Connect by Android, the Livwell app may read (not write) the following data types from Health Connect to power user-visible features. Access is optional and requested via a just-in-time prompt when you enable each related feature. The app remains usable if you decline or later revoke access.
Activity & Readiness
– Steps – used to show daily/weekly activity trends, power streaks/leaderboards, and inform calorie/goal progress.
– Distance – distance travelled for activity tracking.
– Calories burned (Active/Total energy) – activity energy and overall energy burn.
– Floors climbed – stair-climbing metric.
– (Optional, when enabled for specific charts): Elevation gained, Speed, Power, Cycling cadence/Exercise sessions.
Heart & Cardio
– Heart rate (series) – trends/zones; also informs readiness/breathwork prompts.
– Resting heart rate (RHR) – baseline cardiovascular indicator.
– Heart rate variability (HRV) – recovery/stress trends and readiness insights.
– VO₂ Max – cardio fitness level.
Sleep
– Sleep sessions & stages – used to present sleep duration/consistency and stages, and to tailor recovery and readiness insights.
Nutrition & Hydration
– Nutrition (energy, macros) – fuels nutrition cards and goal progress.
– Hydration (fluid intake) – hydration tiles and trends.
Vitals & Health Monitoring
– Body temperature (including basal, where available).
– Oxygen saturation (SpO₂).
– Blood pressure (systolic/diastolic).
– Blood glucose.
– Respiratory rate.
Body Composition
– Weight, Body fat %, Lean body mass – for body-comp dashboard, trends, and personalisation.
Menstrual Health
– Menstruation / Menstruation flow – to support cycle tracking; window and pregnancy-likelihood insights are app-calculated.
How we use and share Health Connect data
– Used solely to provide the features described above (display insights and personalise programs).
– Not used for advertising or advertising measurement, not sold, and not shared with third parties except service providers acting on our behalf under contract to operate the Services (e.g., secure cloud hosting).
– Data is encrypted in transit; if you enable account sync, it is stored securely with your Livwell account. Otherwise, it remains on your device only.
Your choices and controls
– You can change or revoke Livwell’s access at any time in Android Settings → Health Connect (or open the Health Connect app → Permissions → Livwell).
– You can also disconnect within Livwell (Menu → App Integrations → Disconnect) and request deletion of any synced health data by emailing support@golivwell.com.
Wellness-only
Livwell provides wellness insights and is not a medical device and not a substitute for professional medical advice.
Note: The broader list of metrics in Section 2B reflects all sources (e.g., wearables, manual entry). Through Health Connect specifically, Livwell reads only the data types listed in this Section 2C.
D. Personal Information
We collect personal information, such as your name, email address, contact details, and any other information you provide during account registration or when interacting with the Services.
E. Financial or Transactional Data
We collect transactional data related to payments for services booked through the platform (e.g., fitness classes, wellness consultations, and subscription fees).
– Payment Information: card details or other payment methods (processed securely by third-party processors such as Stripe).
– Purchase History: records of services purchased and transactions.
F. Geolocation Data
To enhance your experience (e.g., recommending nearby facilities, tracking outdoor exercise), we may collect:
– Precise Location Data (with your consent) via the app.
– General Location Data based on IP address or similar signals.
You can enable or disable location permissions in your device settings.
G. Information Collected via Technology (No Cookies)
Our website and app do not use cookies or similar tracking technologies. We may collect limited technical information (e.g., device type, operating system version, referring URL) that your browser or device automatically provides, and our app may store on-device, strictly necessary data (e.g., authentication tokens, user preferences) to operate the Services. We do not use this information to track you across websites or apps or for advertising purposes. Third-party websites you access through the Services have their own privacy practices.
3) How We Use Information
- Provide, maintain, and improve the Services.
- Personalise recommendations and content.
- Facilitate bookings, purchases, and payments.
- Communicate with you (e.g., service messages, security alerts).
- Provide analytics, debugging, and fraud prevention.
- Comply with legal obligations and enforce our terms.
No advertising use of health data: We do not use health data—including Health Connect data—for advertising or advertising measurement.
4) How We Share Information
We may share information:
- With service providers/contractors who perform services for us under contract (e.g., hosting, analytics, payments).
- With Subscribers, when you interact with them through the Services (e.g., booking a class with a studio).
- For legal reasons (to comply with law, respond to legal process, or protect rights, safety, and security).
- In corporate transactions (e.g., merger, acquisition, or sale of assets), subject to this Policy or successor protections.
We do not sell personal information and do not share health data for advertising.
5) Sensitive & De-identified Information
We limit our use of Sensitive Personal Information (e.g., precise geolocation, health data, government identifiers) to what is necessary to provide the requested services, ensure security/integrity, comply with applicable laws, or as otherwise permitted by law. We do not use Sensitive Personal Information for advertising.
We may maintain and use de-identified information and will not attempt to re-identify such data except as permitted by law.
6) How We Protect Information
We implement administrative, technical, and physical safeguards to protect information against unauthorised access, including encryption, firewalls, and Secure Sockets Layer (SSL) technology. No method of transmission or storage is 100% secure; by using the Services, you acknowledge these risks.
7) How Long We Retain Information
We retain personal information only as long as necessary for the purposes described in this Policy. In setting retention periods, we consider:
1. how long we provide the Service or maintain your account;
2. legal, tax, audit, and compliance obligations; and
3. the need to establish, exercise, or defend legal claims.
When retention is no longer necessary, we delete or de-identify data.
8) International Data Transfers
We may transfer, store, and process personal data in countries other than your own, which may have different data protection laws and regulations. Regardless of location, we apply consistent protections, including contracts with affiliates, vendors, and suppliers. For transfers involving European personal data, we use Standard Contractual Clauses with our partners.
9) Your Privacy Rights (Region-Specific)
Depending on where you live (e.g., EU/EEA, UK, or US states such as CA/CO/CT/VA/UT), you may have rights to:
– Access, correct, or delete personal information;
– Portability (receive a copy in a usable format);
– Restrict or object to certain processing (including profiling for marketing);
– Opt out of sale, sharing, or targeted advertising (where applicable);
– Appeal if we deny a privacy request.
You can exercise these rights by emailing support@golivwell.com. We will verify your identity, respond within applicable timelines, and explain how to appeal any decision if we cannot fulfil your request. You may also contact your national or state data protection authority.
10) Children’s Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly.
11) User Content in Public Forums
Our sites may offer publicly accessible message boards, blogs, or community forums. Information you disclose in these areas may be viewed, collected, and used by others. To request the removal of your personal information from a forum, contact support@golivwell.com. In some cases, removal may not be possible (e.g., reposts by other users); we will notify you if we are unable to comply and provide the reason.
12) Links to Other Websites
Our Services may contain links to third-party websites or applications. We are not responsible for the privacy practices of those sites. This Policy applies only to information collected by Livwell.
13) Changes to This Policy
We reserve the right to update this Privacy Policy from time to time. Significant changes will be communicated via email or posted on our website. Changes take effect 30 days after notification unless otherwise required by law.
